A. Agreement to These Terms
These Terms of Use ("Terms") constitute a legally binding agreement between you and Kesade Macezu regarding your use of the website at kesade-macezu.info and your participation in any courses or services offered by Kesade Macezu. By accessing the website or enrolling in a course, you confirm that you have read, understood, and agree to be bound by these Terms.
If you are accessing this website or enrolling in a course on behalf of an organization, you represent that you have authority to bind that organization to these Terms. These Terms apply to all visitors, users, and others who access or use the site.
We reserve the right to revise these Terms at any time. Revisions take effect when posted to this page. Continued use of the website following any revision constitutes acceptance of the revised Terms.
B. Eligibility
Our courses and services are designed for adults aged 18 years and over who are located in the United States. By using this website or enrolling in a course, you represent that you meet this age requirement and that you are capable of entering into a binding legal agreement under applicable US law.
We do not knowingly provide services to individuals under the age of 18. If we discover that a user is under 18, we will terminate that user's access to our services without prior notice.
C. Course Enrollment and Services
Submitting an enrollment form through our website constitutes an expression of interest in a course, not a confirmed enrollment. Enrollment is confirmed only when you receive written confirmation from Kesade Macezu by email. Course availability, pricing, and session schedules are subject to change. We will communicate any changes to confirmed participants with reasonable notice.
Course content is provided for educational and personal development purposes. Participation in our courses does not confer academic credit, professional certification, or any formal qualification. Nothing in our course materials constitutes professional advice of any kind.
We reserve the right to cancel or reschedule sessions due to instructor unavailability, insufficient enrollment, or other operational reasons. In the event of a cancellation, we will notify enrolled participants by email and offer alternative session options or a refund of any fees paid.
D. Intellectual Property
All content on this website, including text, images, course materials, logos, and design elements, is owned by or licensed to Kesade Macezu and is protected by applicable US copyright law (17 U.S.C. Β§ 101 et seq.) and other intellectual property laws. You may not reproduce, distribute, publicly display, or create derivative works from any content on this site without prior written permission from Kesade Macezu.
Writing you produce during or in connection with our courses remains your intellectual property. By participating in group sessions, you grant other participants a limited, non-commercial license to read and discuss your shared work within the context of the course only. This license does not extend to reproduction, publication, or any use outside the course environment.
Course materials provided to enrolled participants are licensed for personal, non-commercial use only. You may not share, distribute, sell, or otherwise transfer course materials to third parties.
E. User Conduct
When using our website or participating in our courses, you agree not to: engage in conduct that is harassing, threatening, or harmful to other participants or to our staff; share, reproduce, or distribute course materials beyond your personal use; provide false information in enrollment or contact forms; attempt to gain unauthorized access to any part of our systems; use the website for any unlawful purpose or in violation of any applicable US federal or state law.
We reserve the right to remove any participant from a course, and to block access to the website, for conduct that violates these Terms or that we reasonably determine to be harmful to the learning environment or to other participants. Such removal does not entitle the removed participant to a refund unless separately agreed.
F. Disclaimer of Warranties
This website and all content and services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. Kesade Macezu does not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components. To the fullest extent permitted by applicable US law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that participation in our courses will produce any specific outcome, including but not limited to improvement in writing ability, publication readiness, or any particular creative development. Course outcomes depend on individual effort, engagement, and circumstances outside our control.
G. Limitation of Liability
To the maximum extent permitted by applicable US law, Kesade Macezu shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use this website or our services, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the amount paid by you for the specific course giving rise to the claim.
Some states do not allow the exclusion or limitation of certain warranties or liability for consequential damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
H. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms or your use of our services shall be resolved first through good-faith negotiation. If negotiation does not resolve the dispute within 30 days, either party may pursue resolution through binding arbitration under the rules of the American Arbitration Association, conducted in Cook County, Illinois.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction in Cook County, Illinois to prevent irreparable harm pending the outcome of arbitration.
You agree that any claim against Kesade Macezu must be brought within one year of the event giving rise to the claim, or it is permanently barred.
